Unified Terms of Service for the MyTrusted.ai Ecosystem (Including Bibbit Application and SASI Middleware)
This Unified Terms of Service (the “Agreement”) is entered into and shall be effective as of [Effective Date], by and between Stephen Calhoun, Founder and authorized representative of Technical Visionaries, LLC (“Technical Visionaries,” “Company,” “we,” “us,” or “our”), a company operating at www.techviz.us, together with users and third-party developers engaging with the MyTrusted.ai platform, including its Bibbit application and SASI symbolic AI safety middleware (collectively referred to as the “Ecosystem”).
WHEREAS, the Parties desire to establish legally binding terms governing the access to and use of the Ecosystem, including the rights, responsibilities, and relationships among users, platform/app providers, and third-party developers;
WHEREAS, the Ecosystem is designed to prioritize user privacy, data protection, and transparency by employing symbolic data abstraction, encryption standards, and various privacy modes across its components, ensuring compliance with applicable laws and regulations, including but not limited to the General Data Protection Regulation (“GDPR”), California Consumer Privacy Act (“CCPA”), Children’s Online Privacy Protection Act (“COPPA”), and the European Union Artificial Intelligence Act (“EU AI Act”);
WHEREAS, SASI functions as a privacy firewall and symbolic processing layer, preventing the transmission or storage of raw user data and facilitating user control over privacy preferences;
WHEREAS, this Agreement is intended to provide legal clarity, set forth user rights, define liability limitations, and detail mechanisms designed to ensure data safety and transparency throughout the entire Ecosystem;
NOW, THEREFORE, in consideration of the mutual undertakings set forth herein, the Parties hereby agree to be bound by the terms and conditions contained in this Agreement, which shall remain in effect until terminated in accordance with the provisions herein.
1. Introduction and Acceptance of Terms
This Agreement specifies the terms and conditions for accessing and using the MyTrusted.ai Ecosystem, including but not limited to the main platform, the Bibbit application targeting family use, and the SASI symbolic AI safety middleware.
Each Party, including Stephen Calhoun, Technical Visionaries, LLC, and other users, developers, and entities engaging with any part of the Ecosystem, agrees to be bound by these terms from the Effective Date.
By accessing or using any component of the Ecosystem, you hereby acknowledge that you have read, understood, and agreed to comply with and be bound by the terms of this Agreement. Should you disagree with any of these terms, you must promptly cease all use of the Ecosystem.
2. Scope of the Ecosystem and Application of Agreement
This Agreement encompasses all components within the MyTrusted.ai Ecosystem, which includes the MyTrusted.ai platform, the Bibbit application, and the SASI Middleware.
The “Ecosystem” refers to the integrated environment combining these elements to deliver unified, privacy-centric services to users and third-party developers.
The “Provider” denotes Technical Visionaries, LLC, the entity offering and managing access to the Ecosystem’s components.
“Users” are individuals or entities that utilize the services offered within the MyTrusted.ai Ecosystem.
“Third-Party Developers” are external developers who leverage the SASI Middleware for their applications, adhering to the stipulated privacy and security frameworks.
“Middleware” specifically references the SASI component functioning as a privacy firewall and symbolic data processing layer, essential to safeguarding user data and ensuring compliance across the Ecosystem.
The terms and conditions set forth in this Agreement apply uniformly across all interactions and activities involving the Ecosystem, ensuring cohesive operation, transparency, and mutual accountability among the Provider, Users, and Third-Party Developers.
3. Eligibility And Account Registration
To be considered eligible to access and use the Ecosystem, users must meet specific criteria and adhere to the account registration requirements set forth herein.
a. User Eligibility Criteria:
i. Users must be at least 18 years of age.
ii. Users under the age of 18 are not permitted to register or provide personal information to the Ecosystem in any capacity.
b. Account Registration for Bibbit (Family-facing Application):
i. A parent or legal guardian must create an account on behalf of users under the age of 18.
ii. The parent or legal guardian is required to verify their email address during the registration process.
iii. Stricter identity verification processes will be implemented for enhanced security and compliance with applicable laws.
c. Provider Responsibilities:
i. The Provider reserves the right to request additional information for verification purposes to ensure compliance with eligibility requirements.
ii. The Provider will implement measures to ensure no personal information of users under the age of 18 is processed, as stipulated in this agreement.
d. User Responsibilities:
i. Users must provide accurate and up-to-date information during registration.
ii. Users are responsible for maintaining the confidentiality of their account credentials.
iii. Users must immediately notify the Provider of any unauthorized use of their account or any other breach of security.
e. Opt-In Consent:
i. During the registration process, users must explicitly opt-in to agree to the terms of this Agreement and the associated privacy policies.
ii. Failure to provide explicit consent will result in the inability to complete the registration process and use the Ecosystem.
4. User Rights And Responsibilities
Users of the MyTrusted.ai Ecosystem, including the Bibbit application and SASI middleware, are granted specific rights and are expected to adhere to certain responsibilities to maintain a secure and ethical digital environment. This section outlines these rights and responsibilities to ensure transparency and user empowerment.
User Rights:
Users retain full control over their privacy settings and preferences within the Ecosystem. They are entitled to:
a. Data Access: Users can request access to their Personal Data stored within the Ecosystem at any time, ensuring transparency and control.
b. Data Correction: Users have the right to correct any inaccuracies or update their Personal Data as needed.
c. Data Deletion: Users may delete their Personal Data from the Ecosystem, ensuring that they have the power to manage their digital footprint.
d. Opt-Out: Users have the right to opt-out of the sale of their Personal Data. They can choose to disable specific data-sharing settings or Opt-In and Opt-Out of services as they see fit.
e. Privacy Modes: Users can select different Privacy Modes within the Ecosystem to control their data visibility and sharing preferences. This includes options such as anonymous, pseudonymous, and fully identifiable modes.
User Responsibilities:
a. Accurate Information: Users are responsible for providing and maintaining accurate and truthful information. Inaccurate data can undermine the privacy and functionality of the Ecosystem.
b. Compliance: Users must comply with all applicable laws, regulations, and terms outlined in this Agreement while using the Ecosystem.
c. Security: Users are expected to protect their account credentials and adhere to best security practices to prevent unauthorized access to their data.
d. Respect for Others: Users must respect the rights and privacy of other users within the Ecosystem. Any activities such as harassment, data breaches, or misuse of shared information are strictly prohibited.
Users are encouraged to familiarize themselves with these rights and responsibilities to fully leverage the privacy-centric features of the MyTrusted.ai Ecosystem and contribute to a secure and ethical digital environment.
5. Data Collection, Processing, And Storage
The MyTrusted.ai Ecosystem, including the Bibbit application and SASI middleware, is dedicated to protecting your privacy and strictly manages data collection, processing, and storage in accordance with industry standards and regulatory requirements. Specific data types collected include Personal Data (such as email addresses), Symbolic Data, and full chat storage, the latter only if users opt-in to this feature. The collection, processing, and storage protocols are summarized below:
a. Personal Data: This includes identifiable information such as your email address. This data is collected with user consent and is stored using the latest 256-bit encryption standards. Users have the sole ownership of their encryption keys, ensuring that only they can decrypt their Personal Data.
b. Symbolic Data: This refers to de-identified and encrypted data derived from raw personal information. The transformation to symbolic data ensures that it is processed without identifying the individual. SASI middleware facilitates anonymous processing of AI prompts by third-party large language models (LLMs), ensuring no full-text history or identifiable raw data is transmitted.
c. Privacy Modes: Users can choose between hybrid storage, local-only storage, and USB secure storage options. Hybrid storage uses both local and cloud services (via Firebase/AWS) to enable offline use and seamless device switching, while ensuring that encrypted raw data is inaccessible to AI. Local-only and USB secure storage modes provide enhanced privacy by keeping data solely on user-controlled devices.
d. Processing and Storage: All collected data is processed with strict adherence to user privacy preferences. Raw personal data and symbolic data are stored separately. Encrypted raw data is either kept locally on the user's device or in the cloud, depending on the user’s chosen privacy mode, and it remains inaccessible for AI processing; while symbolic data, devoid of identifiable information, is used for AI interactions.
The data collection, processing, and storage procedures are managed by authorized personnel within the MyTrusted.ai Ecosystem, ensuring that data security and user privacy are upheld at all times.
6. Privacy And Security Mechanisms
The MyTrusted.ai Ecosystem, including the Bibbit application and SASI middleware, is designed with robust privacy and security mechanisms to protect user data at all times. Central to our privacy architecture is the use of symbolic data abstraction and SASI middleware, which functions as a privacy firewall. This firewall ensures that raw personal data is never transmitted or stored, and instead, symbolic data is used to represent sensitive information.
All data operations within the ecosystem are protected using industry-standard 256-bit encryption for both data transfers and storage. Notably, only users hold the encryption keys, ensuring that no unauthorized parties – including developers and administrators – can access sensitive information without explicit user consent.
Our ecosystem supports multiple privacy modes, allowing users to choose their desired level of data protection:
a. Anonymous Mode: Enables users to engage with the platform without revealing their identity, ensuring maximum privacy.
b. Local Mode: Keeps data processing confined to the user’s device, minimizing external data exposure.
c. Hybrid Mode: Balances local processing and cloud-based resources to optimize performance while maintaining a high level of privacy.
d. Cloud Mode: Utilizes cloud infrastructure for processing, enabling enhanced capabilities with encrypted data management.
These measures collectively ensure that user data remains private and secure across the MyTrusted.ai Ecosystem, adhering to the most stringent data protection standards.
7. Compliance With Applicable Laws And Regulations
The Ecosystem, including its Bibbit application and SASI middleware, ensures full compliance with all applicable laws and regulations, specifically the General Data Protection Regulation ("GDPR"), the California Consumer Privacy Act ("CCPA"), the Children’s Online Privacy Protection Act ("COPPA"), and the European Union Artificial Intelligence Act ("EU AI Act"). The primary party, Steve Calhoun, guarantees that the data protection measures and privacy policies implemented across the Ecosystem align with these legal frameworks. Key compliance measures include:
a. Age Restrictions: No personal data from users under the age of 18 will be collected, processed, or stored. For the Bibbit application, parental account creation and email verification are required to ensure compliance with COPPA.
b. User Information and Consent: Users will be informed about the collection, processing, and storage of their personal data, as outlined in section 5. Explicit consent will be obtained where necessary, and clear information about automated decision-making and profiling will be provided in accordance with section 12.
c. Data Transparency and Access: Users will have the right to access, correct, and delete their personal data, as per the guidelines of the GDPR and CCPA. The mechanisms for data access and deletion will be detailed in section 8.
d. Privacy and Security: Implementing comprehensive privacy and security mechanisms to protect user data, as described in section 6. SASI will function as a privacy firewall, ensuring data protection and user control over privacy settings.
e. No Data Sharing with Third Parties: Ensuring that user data will not be shared with third parties unless explicitly authorized by the user or required by law.
f. Compliance Monitoring: Regular audits and assessments will be conducted to ensure ongoing compliance with GDPR, CCPA, COPPA, and the EU AI Act.
8. Privacy Controls, Data Access, And Deletion
Users of the MyTrusted.ai Ecosystem have full control over their privacy preferences through robust privacy controls. These mechanisms are designed to empower users to manage their Personal Data effectively, ensuring compliance with GDPR, CCPA, and other relevant laws. Users may utilize the following features to control their data within the Ecosystem: a. Privacy Settings: Users can easily adjust their privacy settings at any time to suit their personal preferences, including selecting different Privacy Modes that offer varying levels of data exposure and protection. b. Data Access: Users have the right to access their Personal Data stored within the Ecosystem. Requests for data access will be processed promptly, and users will be provided with information about what data is being held and used. c. Data Correction: If any Personal Data is inaccurate or incomplete, users may request corrections, and such requests will be actioned without undue delay. d. Data Deletion: Users can request the deletion of their Personal Data at any time. Upon receiving a deletion request, the data will be permanently removed from all systems within the Ecosystem, and this removal will be immediately effective. e. Opt-In and Opt-Out: Users have the option to opt-in or opt-out of certain data collection and processing activities. Opting out may limit access to some features but will ensure that no unauthorized processing occurs. These mechanisms are detailed further in <<Clause 4: User Rights and Responsibilities>> and support the overarching principle of user-centric data control, promoting transparency, and trust within the MyTrusted.ai Ecosystem.
9. Use Of Sasi By Third-Party Developers
Third-Party Developers ("Developers") may lease and integrate SASI Middleware ("SASI") under this Agreement subject to the following permissions, restrictions, and obligations:
a. Permissions:
- Developers are permitted to lease SASI from MyTrusted.ai for integration into their respective applications and services.
- Developers may utilize SASI solely for the purpose of enhancing privacy and data protection measures within their offerings.
- Access to SASI includes use of middleware APIs, documentation, and support as provided by MyTrusted.ai.
b. Restrictions:
- Developers are prohibited from accessing, transmitting, or storing any raw user data through SASI.
- Developers must not reverse-engineer, decompile, or attempt to derive the source code or underlying structure of SASI.
- SASI must not be used in a manner that violates any applicable laws, regulations, or the terms set forth in this Agreement.
- Unauthorized distribution, sublicensing, or sharing of SASI with any third party is strictly forbidden.
c. Obligations:
- Developers are obligated to maintain confidentiality regarding their integration and use of SASI, especially in relation to any proprietary information provided by MyTrusted.ai.
- It is the responsibility of Developers to ensure that their use of SASI complies with all applicable privacy and data protection laws, as detailed in Section 7 of this Agreement.
- Developers must promptly report any issues, security breaches, or perceived misuse of SASI to MyTrusted.ai.
- While the consequences and process for misuse of SASI are not yet defined, Developers acknowledge that any misuse will be subject to review and potential action as determined by MyTrusted.ai.
10. Liability Limitations And Indemnification
The Provider shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from the use or inability to use the Ecosystem or any of its components, including but not limited to the Bibbit application and SASI middleware. This limitation of liability applies to any and all claims, whether based on warranty, contract, tort, or any other legal or equitable theory.
The User agrees to indemnify, defend, and hold harmless the Provider, including its affiliates, officers, directors, employees, agents, and licensors, from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that may arise from or relate to: (a) the User's use or misuse of the Ecosystem; (b) the User's violation of this Agreement; (c) the User's violation of any rights of another; or (d) any content or data the User submits, posts, or transmits through the Ecosystem.
Third-Party Developers who engage with the Ecosystem, including those using SASI, are solely responsible for ensuring that their services comply with all applicable laws and regulations. The Third-Party Developer shall indemnify, defend, and hold harmless the Provider from any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to their use of SASI, any data processed through their services, or any breach of this Agreement.
The Provider's total liability to any User or Third-Party Developer for any and all claims arising out of or related to this Agreement or the use of the Ecosystem shall not exceed the amount paid by the User or Third-Party Developer to the Provider in the twelve (12) months preceding the event giving rise to the liability, or one hundred dollars ($100), whichever is greater.
11. Intellectual Property Rights
All intellectual property rights associated with the MyTrusted.ai Ecosystem, including but not limited to, trademarks, service marks, logos, patents, trade secrets, know-how, copyrights, and other proprietary rights, collectively referred to as 'Intellectual Property,' shall be owned by the Provider, Steve Calhoun. This ownership includes the intellectual property rights within all components of the Ecosystem, specifically the Bibbit application and SASI middleware.
The Provider grants users a non-exclusive, non-transferable, and revocable license to access and use the Ecosystem components strictly in accordance with the Agreement terms. The rights to use SASI middleware by third-party developers are governed by the <<Section 9: Use of SASI by Third-Party Developers>>.
Users and third-party developers shall not:
a. Copy, modify, distribute, create derivative works, reverse-engineer, decompile, or disassemble any part of the Intellectual Property except as expressly allowed under this Agreement.
b. Use the Intellectual Property for any commercial purpose without obtaining prior written consent from the Provider.
c. Claim ownership rights over any elements of the Ecosystem components or suggest an affiliation with the Provider without express permission.
Any feedback, comments, or suggestions provided by users or third-party developers for improving the Ecosystem shall be deemed non-confidential and shall become the sole property of the Provider. The Provider may use such feedback, comments, or suggestions without any obligation to the user or third-party developer.
Any third-party intellectual property incorporated into the Ecosystem components shall be used in accordance with the relevant agreements and licenses held by the Provider. The third-party developers are solely responsible for ensuring their compliance with any third-party intellectual property rights when integrating or interacting with SASI middleware as defined in <<Section 9: Use of SASI by Third-Party Developers>>.
12. Automated Decision-Making And Profiling Disclosure
In compliance with the EU AI Act, we hereby disclose the use of automated decision-making systems and profiling within the MyTrusted.ai Ecosystem, including the Bibbit application and SASI middleware. Automated decision-making and profiling are employed to enhance user experience, streamline operations, and improve the functionalities and services provided by the Ecosystem.
Automated Decision-Making refers to decisions made by automated means without any human involvement. Profiling involves any form of automated processing of personal data to evaluate certain aspects concerning a User, particularly to analyze or predict aspects related to personal preferences, behaviors, and attitudes.
We utilize Symbolic Data in our profiling and automated decision-making processes. Symbolic Data abstractly represents user interactions, preferences, and behaviors without direct reliance on raw user data, ensuring an additional layer of privacy and protection.
Users are informed and provided with the following rights in relation to automated decision-making and profiling:
a. Users have the right to obtain meaningful information about the logic involved, as well as the significance and the consequences of such processing.
b. Users have the right to request human intervention on certain decisions, express their own point of view, and potentially contest the decision.
c. Users may opt-out of profiling and automated decision-making processes where applicable and legally required.
Further details about compliance and user rights can be found in Section 7: Compliance With Applicable Laws and Regulations and Section 4: User Rights and Responsibilities of this Agreement. If there are any questions or concerns regarding these processes, Users are encouraged to reach out to us as outlined in Section 17: Unified Contact and Notices.
13. Data Breach And Security Incident Notification
In the event of a data breach or security incident that compromises the confidentiality, integrity, or availability of user data, MyTrusted.ai Ecosystem, including the Bibbit application and SASI middleware, commits to taking the following actions promptly and diligently:
a. Identification and Containment: Immediate steps will be taken to identify the scope and impact of the breach or incident, followed by containment measures to prevent further compromise.
b. User Notification: Affected users will be notified without undue delay, and no later than 72 hours after the breach is discovered, detailing the nature of the breach, the type of data involved, the potential consequences, and the measures taken or proposed to remedy the breach and mitigate any potential adverse effects.
c. Authorities Notification: Relevant authorities, including data protection and regulatory bodies, will be informed of the breach within 72 hours in compliance with applicable laws such as GDPR, CCPA, or any other jurisdiction-specific regulations.
d. Incident Investigation and Remediation: An in-depth investigation will be carried out to determine the root cause of the breach, followed by the implementation of corrective measures to prevent future occurrences. Affected users will be kept informed of the investigation progress and outcomes as appropriate.
e. Documentation and Record-Keeping: Detailed records of the breach, including the causes, responses, notifications, and remedial actions, will be documented and maintained for auditing and compliance purposes.
f. Support and Assistance: Affected users will be provided with appropriate support and guidance, including measures to secure their accounts and personal information. Assistance in addressing any issues arising from the breach will also be available.
14. Term, Suspension, And Termination
This Agreement shall commence on the Effective Date and shall remain in effect until terminated as specified in this section. Either Party may terminate this Agreement at any time by providing thirty (30) days written notice to the other Party.
Suspension: The Primary party reserves the right to suspend access to any part of or the entire Ecosystem immediately upon notice if:
a. The other Party breaches any material term of this Agreement and fails to cure such breach within ten (10) days of receiving notice from the Primary party.
b. The Primary party reasonably determines that the conduct of the other Party poses a risk to the security, integrity, or proper functioning of the Ecosystem, or endangers any user, third-party developer, or the Primary party’s interests.
Termination: This Agreement may be terminated by any Party as follows:
a. By either Party, immediately upon written notice, if the other Party becomes insolvent, files for bankruptcy, or ceases its operations.
b. By either Party, immediately upon written notice, if the other Party is found to be in violations of laws and regulations defined in Section 7: Compliance With Applicable Laws and Regulations.
c. The Primary party may terminate the Agreement immediately upon written notice, if it determines that continued provision of services to the other Party becomes commercially impracticable or legally prohibited under any applicable laws or regulations.
15. Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to this Agreement, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, the parties agree to resolve the dispute through binding arbitration. This arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in a mutually agreed location, and if no agreement can be reached, it will default to a location determined by the primary party. All decisions of the arbitrator shall be final and binding on the parties. The arbitrator shall have the authority to award the same damages and relief as a court of competent jurisdiction. The prevailing party shall be entitled to recover its reasonable attorneys' fees and other costs incurred in connection with the arbitration. Notwithstanding the foregoing, either party may seek injunctive relief or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm. Additionally, the parties agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class or representative action. The primary party reserves the right to update or modify this Dispute Resolution clause at any time; any such changes will be communicated to the other parties involved and will be binding upon continued engagement with the Ecosystem.
16. Modifications To The Agreement
The Provider reserves the right to amend or update this Agreement at any time to reflect changes in the law, adjustments to business practices, or enhancements to the Ecosystem's functionality. Any such modifications will become effective upon the earlier of (i) user acceptance of the updated Agreement, or (ii) 30 days following the posting of the changes to the Ecosystem, unless otherwise specified in the modification notice. The Provider will make reasonable efforts to notify users of significant changes by means of electronic communication to the email address on record and/or via in-app notifications. Continued usage of the Ecosystem after the effective date of any modifications constitutes acceptance of the revised terms. Users are encouraged to review this Agreement periodically for updates. If a user does not agree to a modification, they must terminate their use of the Ecosystem in accordance with the termination provisions of this Agreement. Material changes will not be retroactively applied without explicit user consent.
17. Unified Contact and Notices
For any and all correspondence, legal notices, and complaints related to the MyTrusted.ai Ecosystem, including the Bibbit application and SASI middleware, users and third-party developers must direct their communication to the designated official point of contact.

This unified contact system ensures streamlined processing and response to all inquiries, issues, and legal matters. The Ecosystem reserves the right to update this contact information as necessary, with such changes being communicated to users via email or through platform notifications. Any changes made to the contact information shall be considered effective immediately upon communication.
18. Miscellaneous Provisions
a. Severability: If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the provision shall be severed from this Agreement, and the remaining provisions shall continue in full force and effect.
b. Waiver: No waiver by any party of any breach or default of this Agreement shall be deemed a waiver of any preceding or subsequent breach or default. The failure of any party to enforce or exercise any right under this Agreement shall not constitute a waiver of that right.
c. Assignment: The rights and obligations under this Agreement may not be assigned, transferred, or sublicensed by the user without the prior written consent of the Primary Party (Stephen Calhoun, on behalf of Technical Visionaries, LLC). The Primary Party reserves the right to assign, transfer, or delegate its rights and obligations under this Agreement at its sole discretion.
d. Entire Agreement: This Agreement constitutes the entire agreement between the parties with respect to the subject matter herein and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, with respect to such subject matter. This Agreement may only be amended in writing, signed by both parties.
